Every year ECOM conducts an analysis of national legislation related to SOGI and HIV in the countries of our region. We are ready to present the results of the analysis of five EECA countries that we conducted in 2022.
The first country we will focus on is Moldova.
The analysis of legal practice in Moldova includes both judicial practice and government statistics, but also reports submitted by activists, information and statistics of human rights organizations, press reports and reports of non-governmental organizations to international bodies.
The goal of the analysis is to identify legal barriers and problems in those areas where the necessary legislation already exists, but it does not fully ensure the implementation of the rights and freedoms for LGBT people.
The analysis was carried out according to the methodology developed by ECOM experts. Our local partners in Moldova completed the corresponding questionnaire.
As a result, we identified the main restrictions that still remain for LGBT people in the legislation of Moldova. Namely:
- LGBT people are not able to register their relationship, or share custody of children.
- There is a criminal liability in the country for intentional HIV transmission, but no separate liability for unintentional transmission.
- The only normative act that regulates the issues of legal transgender transition is the order «On the establishment of a commission for the determination of gender dysphoria». To start the transgender transition procedure, trans* people must receive an official diagnosis, which is established by the commission.
At the same time, the country has a progressive law on freedom of peaceful assembly, and in 2019 amendments were made to the Law regulating the media, which prohibits the media from discriminating against people on the basis of sexual orientation.
